  12. You should carefully read the following terms and conditions before
  13. using this software. Use of this software indicates your acceptance
  14. of these terms and conditions. If you do not agree with them, do not
  15. use the software.

  18. SHAREWARE VERSION LICENSE

  20. The shareware version is not free software. If you are using the
  21. shareware version you are hereby licensed to use this software for
  22. evaluation purposes without charge for a period of 50 uses. If you
  23. use this software after the 50 uses evaluation period a
  24. registration fee is due (see Ordering Information).

  26. If you are using the Shareware Version of the software you are
  27. also hereby licensed to: Make as many copies of the Shareware
  28. version of this software and documentation as you wish; Give exact
  29. copies of the original Shareware version to anyone; Distribute the
  30. Shareware version of the software and documentation in its
  31. unmodified form via electronic means. There is no charge for any
  32. of the above.

  34. You are specifically prohibited from charging, or requesting
  35. donations, for any such copies, however made; and from
  36. distributing the software and/or documentation with other products
  37. (commercial or otherwise) without prior written permission.

  40. evaluation period is in violation of federal copyright laws.

  43. Extensions (shareware) in any manner.

  46. REGISTERED VERSION LICENSE

  48. One registered copy of Folder Synchronize may be dedicated to a
  49. single person who uses the software on one or more computers or
  50. workstations that are for their own exclusive use and for which
  51. they are the sole user.

  53. A single user license may be used to process as many files on as
  54. many drives or network shares as you like.  However, a single user
  55. license registration may not be made available in any form to
  56. multiple users or workstations.

  58. Licensing is not based on "concurrent" users.  If multiple
  59. workstations are to access the program in any form and for any
  60. length of time you must purchase licenses for the number of users
  61. that will access the program.  If you make the registered version
  62. of Explorer Extensions available through a network and accessible
  63. by multiple users or workstations you are required to purchase
  64. licenses for the software covering all workstations that will
  65. access the software through the network.  Special pricing is
  66. available for multiple licenses.  See Ordering Information for
  67. information on how to purchase (register).

  70. OWNERSHIP RIGHTS

  72. Funduc Software, Inc. owns and retains all copyrights, patents,
  73. trade secret rights, trademarks and intellectual property rights
  74. to this software. Registration &/or use of the software does not
  75. grant you any right to the intellectual property in the product.

  84. RESTRICTIONS

  86. You are prohibited by law from selling, renting, leasing, loaning,
  87. or donating the program or documentation in whole or in part
  88. without specific advance agreement between yourself and Funduc
  89. Software, Inc.  You are prohibited by law from redistributing the
  90. registered version of the program by any method or in any form
  91. except to the specific individuals for whom the software was
  92. purchased.  You are prohibited from decompiling, reverse
  93. engineering, disassembling, or otherwise reducing the program to
  94. human readable form for any purposes whatsoever.  You may not
  95. modify the program or documentation in any manner.  You are
  96. prohibited from permitting anyone else from undertaking any of the
  97. above actions.

  100. Folder Synchronize (registered or shareware) in any manner.

  103. GOVERNING LAW

  105. This agreement shall be governed by the laws of the State of
  106. Michigan.

  109. DISCLAIMER OF WARRANTY

  111. This software and the accompanying files are sold "as is" and
  112. without warranties as to performance of merchantability or any
  113. other warranties whether expressed or implied.  In particular,
  114. there is no warranty for the string Replacing feature.

  116. Good data processing procedure dictates that any program be
  117. thoroughly tested with non-critical data before relying on it.
  118. The user must assume the entire risk of using the program. Any
  119. liability of the seller will be limited exclusively to product
  120. replacement or refund of purchase price.
